Behavioral Health Facility Receives Another Citation for Safety Issues After Employee Injury at Work — Occupational Health & Safety

Circles of Care Inc. has been cited by OSHA for safety lapses after an employee was injured at their Melbourne, Florida facility. The incident occurred on November 7, 2023, when a mental health technician was attacked by a patient, resulting in serious injuries. The investigation found that Circles of Care did not have proper safeguards in place to prevent such incidents, leading to a repeat violation citation. Additionally, the company failed to report the hospitalization of the employee within 24 hours, as required by law.

As a result of these violations, Circles of Care now faces $101,000 in proposed OSHA penalties. This is the third time in five years that the company has been cited for safety lapses that resulted in serious injuries or fatalities. OSHA officials expressed shock at Circles of Care’s failure to protect its employees from the recognized danger of patient violence, which can cause serious harm and trauma to workers.

Circles of Care Inc. has 15 business days to comply with the citations and penalties, request an informal conference, or contest the agency’s findings. OSHA Area Office Director Erin Sanchez in Orlando emphasized the importance of protecting employees from patient assaults and ensuring their safety in healthcare facilities.
