Business Owner Accused of Forging Documents and Filing False Papers in Marijuana Industry

Kelly Waggoner, a resident of Peculiar, Missouri, who owned a marijuana business, was charged with forgery, filing false documents, and identity theft on Tuesday. A criminal summons was issued and an initial court appearance was scheduled for 9 a.m. on Wednesday, July 17. Waggoner is accused of submitting forged documents with signatures from past investor documents to the Missouri Department of Health and Senior Services as part of an attempt to comply with DHSS regulations. The probable cause statement filed by the Missouri State Highway Patrol reveals that he is the founder and CEO of Red Tractor Cultivation.

Court documents state that the value of the business was increased as a result of Waggoner’s actions. He then allegedly sold the business’ marijuana licenses to an investor from St. Louis without disclosing the sale to investors or the DHSS. Waggoner is also accused of raising capital from investors through the sale of convertible notes, some of which were allegedly used to purchase an SUV, personal items, and legal fees.

Allegedly, Waggoner reused these documents without the investor’s consent in an effort to meet DHSS regulations. The criminal documents suggest that the value of the business was increased by these actions. Additionally, Waggoner is accused of selling the business’ marijuana licenses to an investor without informing other investors or the DHSS about the sale. To raise capital, he sold convertible notes to investors, some of which were then allegedly spent on personal expenses and legal fees.
