The Consumer Financial Protection Bureau (CFPB), Department of Health and Human Services (HHS), and United States Treasury have jointly released an interagency Request for Information (RFI) focused on financing for health care procedures and services. The issuance of this RFI indicates a renewed focus on and potential scrutiny of the practices of health care providers, lenders, credit card issuers, as well as those who own or control health care providers such as private equity investors and asset managers. This white paper will discuss the RFI and explore its potential implications for health care providers and stakeholders involved in financing health care services. Additionally, it will provide recommendations for stakeholders to anticipate inquiries from the CFPB regarding the use of medical payment products and the collection of related debt. Lastly, it will address the possibility that the CFPB may attempt to expand its regulatory authority by utilizing the RFI and subsequent investigations to broadly examine the pricing practices implemented by health care providers.
