The reckoning, if there will be one, could be coming this week. Closing arguments in the trial of the Sunday Ticket class action against the NFL are set to happen on Wednesday. All evidence has been presented and the jury will be instructed as to the law that applies to the case. Jury deliberations will begin on Wednesday morning or afternoon, with the jury deliberating until a verdict is reached or an impasse is declared. If the NFL loses, the presiding judge could still enter judgment notwithstanding the verdict for the defense.
Regardless of the outcome, an appeal to the U.S. Court of Appeals for the Ninth Circuit remains a possibility. The league may have a stronger case on the law than on the facts presented in the trial. There is evidence to support a jury verdict on whether the league required Sunday Ticket to be priced high enough to ensure consumers would watch games on local CBS and/or Fox affiliates instead. It seems that the league could have made the product available at a lower price, but chose not to do so.
No matter the result, remember the next time they tell you football is family, that the legal battle over Sunday Ticket may reveal a different side of the game.
