Popular soda brand Poppi is currently facing a class-action lawsuit filed by a consumer who claims that their products do not actually provide the gut health benefits that are suggested by their marketing. In the lawsuit, Kristin Cobbs alleges that she purchased Poppi drinks based on their labels, which claim to be prebiotic sodas with the slogan “Be Gut Happy. Be Gut Healthy.” However, Cobbs discovered that Poppi drinks only contain around 2 grams of prebiotic agave inulin fiber, which she believes is insufficient to offer any real benefit. Research cited in the lawsuit indicates that consuming 7.5 grams of agave inulin daily for three weeks did not provide meaningful prebiotic benefits.

Cobbs argues that any potential prebiotic benefits from drinking more Poppi would be outweighed by the increased sugar consumption from the drinks. She is seeking monetary relief for herself and other similar customers who may have been misled by the marketing of Poppi products. Poppi, based in Austin, Texas, has stated that they stand behind their products and believe the lawsuit is baseless. They intend to vigorously defend against the allegations.

Poppi is just one of many brands in the rapidly growing category of functional beverages that claim to improve health and wellness. Sales of prebiotic and probiotic drinks in the U.S. have more than tripled in the past year, according to data from consulting firm AlixPartners. As the lawsuit against Poppi progresses, it will be interesting to see how it impacts the larger landscape of the functional beverage industry.
