Elon Musk dropped his lawsuit against OpenAI and two of its co-founders, Sam Altman and Greg Brockman, on Tuesday, according to CNBC. The lawsuit had been filed in March, with Musk accusing the AI startup of abandoning its nonprofit mission. Musk, Altman, and Brockman had co-founded OpenAI in 2015.

The lawsuit withdrawal came just before a judge was set to address the case during a hearing in San Francisco. In his lawsuit, Musk had criticized the company’s partnership with Microsoft, claiming it prioritized profits over benefiting humanity. Musk had left OpenAI in 2018 but filed the lawsuit in response to the company’s alleged change in strategy.

Experts had previously questioned the strength of Musk’s case, pointing out the absence of a written contract between Musk and Altman. OpenAI had dismissed the lawsuit as “incoherent” and “contradictory,” suggesting Musk was envious of the company’s progress without his involvement.

Despite the legal battle, Musk continued to publicly criticize OpenAI on social media. Representatives for Altman, OpenAI, and Musk did not immediately provide comments on the lawsuit.
