In this episode of his “Clearly Conspicuous” podcast series, consumer protection attorney Anthony DiResta delves deeper into the Federal Trade Commission’s approach to regulating artificial intelligence (AI) in the second part titled “An FTC Official Speaks About the Regulation of AI Technology.” The FTC has been directed by the Biden Administration’s executive order on AI to use its authority to safeguard consumers against bias and discrimination in AI technology.

Mr. DiResta highlights the importance of companies being aware of potential liability for the actions of AI vendors and contractors. To mitigate this risk, he suggests implementing compliance measures such as pre-release assessments, transparency, vetting vendors, employee training, and monitoring. As the landscape of AI regulation evolves, he mentions that the FTC will continue to utilize its jurisdiction over unfair practices to address harmful AI applications. Additionally, he anticipates the emergence of more comprehensive federal and state AI laws in the future.
