Is Competency Required for Keeping Up with Technological Developments?

Lawyers are often perceived as slow adopters of technology due to their cautious and conscientious nature. They are trained to carefully consider the risks involved in any approach they take when dealing with legal issues. This cautious mentality sometimes leads to lawyers being slower to embrace new developments in technology compared to professionals in other fields.

However, it is important for lawyers to keep up with technological advancements that could impact their practices. For example, Comment 8 to ABA Model Rule of Professional Conduct 1.1 emphasizes the importance of lawyers staying informed about changes in the law and its practices, including the benefits and risks of relevant technology. It encourages lawyers to engage in continuous education and training to maintain the necessary knowledge and skills. While many states have adopted or are considering similar language in their regulations, Georgia has not yet implemented Comment 8.
