State authorities seeking more victims of alleged scam by Alabama window business

Alabama Attorney General Steve Marshall has successfully obtained a restraining order against Legend Windows, LLC for deceiving customers into paying deposits for new windows and doors without delivering the promised products. The restraining order, granted by the Circuit Court of Shelby County, also applies to individuals associated with the business, including Jody Ray Whitworth, Bobby Ray Whitworth, and Robin Simmons Willard. The order includes an asset freeze and prohibits the business from continuing operations while the case is under review.

In a news release, Marshall expressed his determination to hold Legend Windows and the Whitworths accountable for their fraudulent activities, stating that they have victimized many consumers over an extended period. The state’s complaint alleges that the company violated the Alabama Deceptive Trade Practices Act numerous times, with more than 40 known victims across the state who are collectively owed over $181,000 in damages.

The complaint further accuses Jody Whitworth of misusing customer payments for personal expenditures instead of fulfilling the promises made by the business. An investigation revealed that between September 2022 and March 2024, the Legend Windows bank account was used to make over 1,100 purchases from Amazon, totaling approximately $50,000. Additionally, the business made purchases from numerous other retailers, amounting to over $20,000. The attorney general’s office suspects that there may be more victims statewide and has created an online survey for individuals with unresolved claims to report their experiences.

Those who believe they may have been affected by the actions of Legend Windows can visit the attorney general’s website to provide information about their situation and seek redress for any losses incurred. The efforts to address the fraudulent activities of Legend Windows and its affiliates are part of the state’s commitment to protecting consumers from deceptive business practices and holding perpetrators accountable for their actions.
