Supreme Court Faces Challenges in Resolving Tribal Health Care Funding Dispute

The US Supreme Court recently discussed how to allocate a finite amount of funding for tribal health care in a legal dispute regarding whether tribes have the right to seek reimbursement for certain administrative expenses. Justice Amy Coney Barrett described the Indian Self-Determination and Education Assistance Act as a complicated statute during arguments on Monday.

This law aims to promote tribal-run health care programs by allocating funds that would typically be utilized by the Indian Health Service for the same purpose. However, tribes incur additional overhead costs that the health service does not have.
