Texas Mental Health Facility Required to Provide Video Footage to Advocate

A federal appeals court has ruled that a mental health facility in Houston must comply with a disability rights organization’s request to release surveillance footage of a former patient who claims he was abused while in its psychiatric intensive care unit. The ruling was made by the US Court of Appeals for the Fifth Circuit in an opinion written by Judge Carl E. Stewart.

The court found that the Health Insurance Portability and Accountability Act (HIPAA) does not prevent the release of the video footage. This decision affirms the summary judgment ruling and injunction in favor of Disability Rights Texas, which was issued by the US District Court for the Southern District.

The case involved a dispute over the rights of individuals with disabilities who are in psychiatric care. The mental health facility was required to release the surveillance footage in order to ensure the former patient’s allegations of abuse were properly investigated.

The ruling sets an important precedent for the protection of individuals with disabilities and underscores the importance of transparency and accountability in mental health facilities.
