Tower Health, a Pennsylvania-based healthcare provider, successfully defended against a proposed class action lawsuit that accused it of sharing patients’ personal health information with Meta Platforms Inc. in violation of the Electronic Communications Privacy Act and common law. The plaintiffs, Patrick Santoro and Jessica Landis, were unable to demonstrate that the information disclosed to Meta was sensitive health information, according to Judge John F. Murphy of the US District Court for the Eastern District of Pennsylvania.

Judge Murphy stated that the failure of the plaintiffs to show that the shared information was sensitive health data was detrimental to their claims of negligence, intrusion upon seclusion, and violations of the ECPA. As a result, he dismissed the lawsuit without giving Santoro and Landis the opportunity to amend their complaint.

Santoro and Landis had alleged that Tower Health had improperly shared their health information with Meta Platforms Inc., leading to their legal action. However, their inability to prove that the disclosed information was sensitive health data ultimately led to the case being dismissed by Judge Murphy. Tower Health successfully defended itself against the allegations brought by the plaintiffs.
